Aspire Investments & Insurance Ltd. – Terms of Service

These Terms of Service (“Terms”) govern your use of the website at aspireplanning.ca (the “Site”) and our SMS/text messaging program, operated by Aspire Investments & Insurance Ltd. (“Aspire,” “we,” “us,” or “our”).
By accessing the Site, submitting a form, or opting in to receive text messages from us, you agree to these Terms. If you do not agree, please do not use the Site or our messaging services.
These Terms do not replace or override any client service agreement, account application, insurance application, or policy contract you have entered into with us or with a carrier. Where those documents conflict with these Terms, those documents govern.
1. About us
Aspire Investments & Insurance Ltd. is a financial planning firm based in Alberta, Canada, providing investment and insurance advice and services. Our advisors are licensed in the jurisdictions in which they conduct business, and insurance and investment products are offered through the applicable carriers, dealers, and managing general agencies with which we are contracted.
2. No advice through the Site
The content on this Site — including articles, calculators, commentary, and general information — is provided for informational and educational purposes only. It does not constitute financial, investment, insurance, tax, legal, or accounting advice, and it is not a recommendation to buy, sell, or hold any security or insurance product.
Advice is only provided through a direct advisory relationship, after we have gathered and reviewed information about your specific circumstances. No advisory relationship is created by visiting the Site, reading its content, submitting a form, or exchanging text messages or emails with us.
Before acting on any information found here, consult a qualified professional about your own situation.
3. No offer or solicitation
Nothing on this Site constitutes an offer or solicitation to buy or sell any product or service in any jurisdiction where such an offer or solicitation would be unlawful, or to any person to whom it would be unlawful to make it. Products and services described on the Site may not be available in all provinces or territories.
4. Investment and insurance risk
Investments carry risk, including possible loss of principal. Commissions, trailing commissions, management fees, and expenses may all be associated with investment products. Past performance is not indicative of future results, and values change frequently.
Insurance coverage, benefits, exclusions, and premiums are governed solely by the terms of the policy issued by the carrier. Any description of coverage on this Site or in our communications is a summary only — the policy document controls.
5. SMS Terms of Service
By opting into SMS from a web form or other medium, you are agreeing to receive SMS messages from Aspire Investments & Insurance Ltd. This includes SMS messages for conversations (between employees) and conversations (external).
Consent. You must be the account holder or an authorized user of the mobile number you provide, and you must be at least 18 years of age. Consent to receive text messages is not a condition of purchasing any product or service from us.
Types of messages. You can expect to receive appointment reminders and scheduling messages, account and policy service updates, document and signature requests, responses to inquiries you have initiated, and other conversational messages related to your financial planning relationship with us.
Message frequency. Messaging frequency may vary depending on your relationship with us and the nature of your inquiry.
Cost. Message and data rates may apply. Standard rates from your mobile carrier apply to messages you send and receive. We do not charge a fee for the messaging program itself.
Opting out. To opt out at any time, text STOP to any message you receive from us. We will send a single confirmation message and will not send further SMS messages to that number. To rejoin, opt in again through a web form or contact us directly.

Delivery. Delivery of messages is subject to effective transmission by your mobile carrier and is not guaranteed. Carriers are not liable for delayed or undelivered messages. Do not rely on SMS for time-sensitive or urgent instructions — contact our office directly instead.
Security. SMS is not a secure channel. Do not send account numbers, Social Insurance Numbers, banking details, passwords, health information, or other sensitive personal information by text message.
Instructions and transactions. We do not accept trade instructions, transfer requests, beneficiary changes, or other transactional instructions by text message. Requests of this nature must be made through our documented processes.

6. Email and electronic communications
Email is not a secure or reliable channel. We cannot guarantee that emails sent to or from us will be received, or received without delay or alteration. As with SMS, we do not accept transactional instructions by email unless they follow our documented process, and we ask that you not send sensitive personal information by unsecured email.
7. Acceptable use
You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable law or regulation
- Attempt to gain unauthorized access to the Site, our systems, or any account
- Introduce viruses, malware, or other harmful code
- Use automated means to scrape, harvest, or collect information from the Site
- Interfere with or disrupt the operation of the Site
- Impersonate any person or misrepresent your affiliation with any person or entity
- Send abusive, harassing, or unlawful content through our messaging or contact channels
We may suspend or terminate access to the Site or our messaging program at any time for conduct we reasonably believe violates these Terms.
8. Intellectual property
The Site and its content including text, graphics, logos, the Aspire name and marks, and the arrangement of content are owned by or licensed to Aspire and are protected by Canadian and international intellectual property laws. You may view, download, and print content for your own personal, non-commercial use. Any other reproduction, distribution, modification, or commercial use requires our prior written consent.
9. Third-party links and content
The Site may link to third-party websites, tools, or resources. These are provided for convenience only. We do not control, endorse, or take responsibility for the content, products, services, or privacy practices of third-party sites. Accessing them is at your own risk and subject to their terms.
10. Accuracy and availability
We make reasonable efforts to keep the Site accurate and current, but content may become out of date and may contain errors or omissions. Tax rules, contribution limits, product features, and rates change frequently. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, and we may modify, suspend, or discontinue any part of the Site at any time without notice.

Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law, and nothing in these Terms affects our professional obligations to you as a client.
13. Privacy
Your use of the Site and our messaging services is also governed by our Privacy Policy, available at https://aspireplanning.ca/privacy-policy, which is incorporated into these Terms by reference.
14. Governing law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta. You agree that the courts of Alberta have jurisdiction over any dispute arising from these Terms or your use of the Site.
15. Changes to these Terms
We may update these Terms from time to time. The current version will always be posted at aspireplanning.ca with the effective date noted at the top. Your continued use of the Site or our messaging services after changes are posted constitutes acceptance of the revised Terms.
